Recently, the employment tribunal in the UK has confirmed that Uber drivers are neither employed by Uber nor self-employed. The Uber drivers are considered “workers”. This category sits between employee and the genuinely self-employed person, yet gives Uber drivers entitlement to minimum wage and holiday pay. This in-between category of workers is not recognized in Dutch employment status cases. It is clear from Dutch case law that a person is either considered an employee or a self-employed person.
