Methods of dispute resolution
When a dispute arises, we aim to work with you to reach a careful and sustainable solution, preferably without court involvement. This requires knowledge of and understanding of the interests of all parties involved. It is therefore important to engage in dialogue with the person with whom the dispute exists. If it is not possible to reach a solution together, we act decisively and efficiently proceed with litigation.
There are various methods of dispute resolution:
Mediation
Mediation aims to resolve issues together under the guidance of a neutral third party, a mediator. A mediator guides the negotiation process in a confidential setting and provides the necessary legal information. We have several mediators who have completed the specialization training of vFAS. In family and inheritance disputes, we are therefore happy to act as mediators. Together, we take on the challenge of bringing the dispute to a successful resolution.
Collaborative Divorce | Overlegscheiding
This method offers the same advantages as mediation and ensures that there is balance between partners in knowledge, skills, emotions, and power. Each partner is assisted by their own attorney-divorce mediator. The meetings take place under the guidance of a coach/psychologist. If necessary, an independent financial advisor is involved. In an environment of mutual respect and open communication, the foundation for a new future is laid. Litigation
Litigation is the step taken when the parties involved have not been able to reach a solution together. The dispute is then submitted to a court. Each party is assisted by their own lawyer. All positions are presented in writing and usually also discussed orally at a court hearing. The judge delivers a ruling or determines that additional information is required, for example by appointing an expert. If one of the parties disagrees with the ruling (exceptions apply), they can appeal to the court of appeal. After that, there is still the possibility of cassation. For this, we also have our own cassation lawyers.
