Seminar privacy, integrity & security in the workplace

Privacy and ensuring integrity in the workplace require a careful balance between the rights of (future) employees and managing business risks. How do you ensure that this balance is maintained, while at the same time protecting the security and integrity of your organization? This is where compliance with labor law frameworks in pre-employment screening, employee screening plays a crucial role. What methods of investigation are legally justified in this regard? For example, when can you use a detective agency? And what are your risks if it comes to disciplinary action or dismissal?

Program content
The content program of the seminar is as follows:

-Pre-employment screening and employee screening
Using current affairs and practical examples, Floortje Eijdems and Fatma Pamuk will guide you through the AVG requirements on the topics of pre-employment screening and person-oriented research. What is legally allowed and not allowed when screening potential employees? When is an employer allowed to conduct (person-oriented) employee screening? How far may an employer go without seriously violating the privacy of employees? You will get guidance on how to make these processes AVG compliant.

-Levent Bedrijfsrecherche
René Reijenga and Hulya Kapanci discuss how organizations can strengthen their screening methods in a time of increasing threats from foreign actors.

Topics such as advanced technologies, psychological evaluations and international cooperation will be covered, with practical tips for balancing (national) security and inclusiveness. Speakers will share their expertise on integrity, transnational behavior, insider threats and the effective design of screening processes, including their legal and ethical aspects.

-Employment law consequences of (un)careful screening
Suzan Wolters discusses the matter of employee screening from an employment law perspective. Questions will be discussed such as: can I terminate an employment contract if it appears that the employee does not (or no longer) meet integrity requirements? What investigation can I use if I don't trust a sick report? What employment law basis is needed for targeted fraud investigations? Does a careless investigation have consequences for summary dismissal? Or could it cost the organization extra money? Using examples from case law and your own practice, you will be well prepared for future incidents involving employees that require investigation.
