Webinar: explanation of property law

On Tuesday, November 24, 2020 from 12:30 PM - 1:30 PM the webinar 'Explanation of property law' will be held by  mr. R.J. (Roderic) ter Rele. Participation is free of charge. There are 2 training points associated with taking this course as part of the Permanent Training in the Legal Profession.

During the webinar we will discuss:

  • Explanation of pledge deeds:
    – HR February 22, 2019, ECLI:NL:HR:2019:268, HR November 22, 2019, ECLI:NL:HR:2019:1841 and HR 3 April 2020, ECLI:NL:HR:2020:590.
    – Distinction between title and determinability requirement. Different standard of explanation. Relevance of the difference.
    – It must be determined through explanation whether a public or an undisclosed lien is being established. Principle: “the aim is to provide the broadest possible security”. The Supreme Court does something similar in Coface/Intergamma. It is bank friendly.
  • Interpretation of deeds regarding registered property:
    – Objective interpretation of legal acts under property law (e.g. HR Kamsteeg/Lisser).
    – In principle subjective interpretation of non-property law clauses in deeds .
    – Objective explanation of non-property law clauses intended to determine the legal position of third parties (continuous clause). HR February 2, 2018, ECLI:NL:HR:2018:148. Make comparison with explanation measure in HR Coface/Intergamma.
