Environmental law

Environmental law is an area of permanent tension between general and private interests. These last few years both European and national rules in the field of the environment have continuously been amended and – in most cases – tightened. Although environmental law is becoming increasingly important, it is becoming less clear to most citizens and companies what is and is not permitted. That lack of transparency is aggravated by the fact that an increasing number of rules are being adopted at a European level. These developments require a sharp and expert view in order to translate the applicable legislation and regulations into everyday practice. BANNING has the knowledge and experience required for that purpose, pooled in the Environmental Law practice group.

That practice group is on your side if you are confronted with enforcement actions of the authorities. The practice group can also provide you with specialist support in the event of problems regarding the granting or withholding of permits. An important development is the introduction of the Environmental Permitting General Provisions Act (Wabo), under which milieuvergunningen (environmental permits) were converted into omgevingsvergunningen (integrated environmental permits), which is expected to have major consequences in practice. Finally, our practice group considers itself a specialist in the field of waste substances law/recycling.

In addition to the problems referred to above, the Environmental Law practice group is also an expert in the field of environmental liability law. A good example of this is government liability law, because governments regularly make mistakes that can give rise to liability and to the resulting liability for damages. However, special rules apply in that context. Our practice group also has broad experience in other environment-related (liability) fields, such as soil contamination, hazardous substances and other types of environmental damage.
